In the event of any ties, the Entry with the highest score in criterion (iv), Relevance to the Theme of the Contest, will prevail. In the event there are still any ties, the tied Entries will be rescored and the Entry with the highest overall Judges Score will prevail. If the winner is found to be ineligible or does not comply with these Official Rules, he/she will be disqualified and the Entry with the next-highest Judges Score will be named the winner. If the winner is not the owner of the residence (ex., the winner rents the residence), the winner must have permission from the property owner to receive the Prize. Sponsor may require such permission in writing before the Prize will be awarded. Winner’s residence must have reasonable access to the location for the snow-making equipment, as determined by Sponsor or the Prize installer, in their sole discretion. Winner is responsible for being aware of any homeowner association, subdivision, neighborhood, and/or local rules and restrictions that may impact the installation of the Prize at his/her residence. Only one (1) Prize will be available in the Contest. The ARV of the Prize is up to $10,000, and depends on the elements selected by Sponsor based on the winner’s residence. All details of the Prize are determined by Sponsor in its sole discretion. Any difference between the stated ARV and the actual value of the Prize will not be awarded.
-
- General: In no event will more than one (1) Prize be awarded. If, for any reason, more than one (1) Prize notification is sent (or more than one [1] claim is received), Sponsor reserves the right to award the Prize based on the Judges Scores from among all eligible Prize claims received. No Prize substitution or exchange will be allowed, except by Sponsor, who reserves the right to substitute a prize of equal or greater value in case of unavailability of the Prize or force majeure. The winner shall be solely responsible for payment of any and all applicable federal, state, and local taxes for any Prize won. All other costs and expenses not expressly set forth herein shall be solely the winner’s responsibility. The Contest Entities shall not be held responsible for any delays in awarding the Prize for any reason. If after a good-faith attempt Sponsor is unable to award or deliver the Prize, the Prize may not be re-awarded.
- HOW TO CLAIM THE PRIZE: The potential winner is subject to verification of eligibility and compliance with these Official Rules. Sponsor will notify the potential winner by either replying to the Entry made to the Page’s Post (if the entrant entered on Facebook), or by sending him/her a Direct Message on Twitter (if the entrant entered on Twitter)with instructions on how to redeem the Prize. The potential winner must follow the instructions to redeem the Prize, including providing all requested information, including, but not limited to, his/her full name, e-mail address, date of birth, and mailing address (P.O. Boxes are not permitted) within forty-eight (48) hours or the potential winner may be disqualified, and the Prize may be forfeited in its entirety. Potential winner will also be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) and any other requested documents within the stated time or the Prize may be forfeited in its entirety and awarded to an alternate winner, at the Sponsor’s sole and absolute discretion. Failure to provide all required information, including the requested signed documents, within the stated time period may result in forfeiture of winner’s right to claim the Prize and may result in the Prize being awarded to an alternate winner, if time permits. The potential winner may be subject to a background check before the Prize is awarded. Sponsor reserves the right to disqualify the potential winner based on the results of such background check if Sponsor determines in its sole discretion that awarding the Prize to any such individual might reflect negatively on the Sponsor. Upon verification of eligibility, the winner will be contacted by Sponsor’s designee to schedule Prize installation. If the potential winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept the Prize, or any winner notification is returned as undeliverable or the potential winner fails (a) to respond to the winner notification via Facebook/Twitter within forty-eight (48) hours, or (b) to complete the required documents within the stated time period, the Prize may be forfeited. If the Prize is forfeited for any reason, it may be awarded to an alternate potential winner, at the Sponsor’s sole and absolute discretion, selected based on the Judges Scores of the remaining pool of eligible Entries received during the Entry Period, time permitting. Prize is not transferable and includes only the items specifically listed as part of the Prize. No substitution or cash equivalent of Prize is permitted except at the sole discretion of the Sponsor. If the Prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute the Prize or portion thereof with another prize of equal or greater value. Any portion of Prize not accepted by winner will be forfeited. Federal, state, and local taxes on the Prize and any expenses relating to the acceptance of and use of the Prize not specified herein are the responsibility of the Prize winner. ARVs are as of the time these Official Rules were printed and the value of the Prize may fluctuate. The winner is not entitled to any difference between the ARV and the actual value of the Prize at the time the Prize is awarded. All other costs and expenses not expressly set forth herein shall be solely the winner’s responsibility.
